Nadex Self-Certification Regarding Market Maker Quoting Obligations

On July 12, 2017, North American Derivatives Exchange, Inc. (“Nadex”, the “Exchange”) submitted to the Commodity Futures Trading Commission (the “Commission”), pursuant to Section 5c(c)(1) of the Commodity Exchange Act, as amended (“Act”), and section §40.6(a) of the regulations promulgated by the Commission under the Act (the “Regulations”), its intent to amend its Rulebook, Fee Schedule, and Market Maker Agreement to provide notice that as of July 26, 2017, Market Makers may only submit Post-Only Quotes to the Exchange. Market Makers will continue to be temporarily relieved of their quoting obligations when 90% of the applicable position limit has been met, in accordance with Rule 4.4. Additionally, this submission requires the Market Maker to make a good faith effort to price Designated Classes in the Demo environment. Nadex plans to implement these changes for the open of business on trade date July 26, 2017.
