Pursuant to Section 5c(c)(1) of the Commodity Exchange Act, and Commission Regulation §40.6(d)(2)(iv), and by the authority granted by Nadex Rules in 12.5, 12.63, and 12.65 Nadex added additional strike levels on a discretionary basis in its Daily Gold, US Tech 100, and Wall Street 30 Binary Contracts for trade date May 23, 2012 due to volatility in the underlying markets on that day. Nadex returned to the regular listing schedule for these contracts on May 24, 2012. Nadex also added additional strike levels on a discretionary basis in its Weekly Gold Binary Contracts for trade date May 24, 2012 due to volatility in the underlying markets on that day. Nadex returned to the regular listing schedule for these contracts on May 29, 2012.
Additionally, pursuant to Commission Regulation §40.6(d)(2)(i), Nadex is correcting an error in its Holiday Product Schedule Guidelines regarding the contract open time for the Currency Wide Spread Variable Payout Contracts, and is removing reference to the India 50 contracts.
Pursuant to §40.6(d)(2)(i), Nadex is amending its Rulebook to replace references to “Nadex, Inc.” in the Rulebook footnotes with “Nadex”, and is correcting a numbering error in Rules 3.1 and 4.4.
Finally, pursuant to §40.6(d)(2)(i), Nadex is changing its description of its Rollover Schedule in the contract specifications detailed in its Rulebook, by removing the Futures Expiration Date Chart and accompanying detail with specific dates from all commodity and index contract specifications found in Rules 12.2–12.15, 12.48-12.51, and 12.54-12.65, and replacing that Chart with language explaining how each Start and End Date is determined. “Start Date” and “End Date” have been added as defined terms in Rule 1.1, and the existing defined terms have been renumbered to accommodate these additional definitions. For customer convenience, the specific Start and End Dates will continue to be listed on the Nadex website.
